Illegal Waste Transport Crackdown in Marcianise

The military personnel of the Marcianise Forestry Carabinieri Unit, during a service aimed at combating the illegal transport of waste, in the countryside of the municipality of Teverola, caught a truck owned by a construction company, whose container was covered by a tarp, inside of which soils from excavations were being transported. The driver of the vehicle was unable to provide any information about the traceability of the transported waste and not even a laboratory analysis certificate attesting to their non-hazardousness. It is necessary to specify that earth and rocks from excavations can be reused as by-products, or in derogation to waste legislation, only if certain conditions are met such as meeting environmental quality requirements, that is, they do not show concentrations of pollutants above established limits, and that their traceability is guaranteed by a prior declaration to the competent authorities of movement from the place of production to the destination. The truck in question was not registered with the Environmental Managers Register, which is the primary condition for being able to transport special waste. Therefore, specific criminal responsibilities have emerged against the driver of the vehicle in terms of the crime of illicit management of special waste as provided by the Environmental Consolidation Act, or for having carried out an unauthorized special waste management activity and transport with a truck not registered in the environmental managers register, the aforementioned military personnel proceeded to the seizure of the truck and the waste described above, and reported the same to the judicial authority, while at liberty, for the aforementioned crime.
