Dissolution of Sparanise City Council for Alleged Camorra Infiltrations Upheld

The decree that ordered the dissolution of the Sparanise municipal Council in December 2022 due to alleged Camorra infiltrations is legitimate. This was decided by the Lazio Regional Administrative Court (TAR) with a judgment that rejected an appeal proposed by the former mayor. According to the administrative judges, "the numerous elements reported in the reports supporting the existence of an influence on the municipal administrative apparatus by individuals connected to local crime, whose existence was not effectively contested with the proposed grievances, highlight a probative framework fully capable of supporting the contested determinations." For the TAR, the report from the Prefecture of Caserta, later incorporated into the dissolution decree, "reported a series of significant events regarding the existence of established relationships of mutual interest between the municipal administrators and individuals connected to local organized crime. The dissolution decree must be considered fully legitimate, in respect of the principles affirmed by jurisprudence in the matter, having highlighted the presence of repeated contacts and related to the managerial choices of the municipal administration’s top political-administrative bodies with individuals belonging to local crime, and the complete inadequacy of the same political-administrative leadership to perform their duties of supervision and verification towards the bureaucracy and the managers of public services of the Municipality."
