Domestic Abuse and Aggravated Assault Leads to Restraining Order and Electronic Monitoring

After the investigations coordinated by the Prosecutor's Office of Benevento, the carabinieri of Airola executed the court order for removal from the family home, issued by the investigating judge, which prohibits approaching the victim and the places she frequents, against a 37-year-old man from Moiano, who is seriously suspected of domestic abuse and aggravated assault against his spouse. Therefore, the man is required to stay at least 500 meters away from the aforementioned places and the victim, with the method of control being electronic monitoring. The investigations were initiated by the woman's complaint, who, after another domestic dispute and the latest assault, reported the level of psychological pressure she had been subjected to for years due to her husband's behavior, which, according to the charges, was becoming increasingly oppressive, aggressive, and intimidating towards her. These behaviors were considered to be daily, including frequent physical assaults even in front of their minor children, as well as 'continuous interference in every aspect of the spouse's daily life, preventing her from independently carrying out work activities and subjecting her to constant and pressing control by her spouse'. Moreover, according to investigators, the man physically assaulted his spouse with punches and slaps during a trivial argument, 'leading the young woman to immediately decide to leave the home and report the facts'. Through the acquisition of statements from the victims as well as other family members aware of the facts and the neighbors of the family unit, after further police investigations, the measure was also taken in light of 'cautionary needs and the danger of committing similar acts'. In any case, the measure was ordered during the preliminary investigation stage, against which appeals are allowed, and the recipient remains under investigation and therefore presumed innocent until a final sentence is issued.
