Naples Labor Court Rules in Favor of Medical Manager for Fair Compensation During Covid-19 Vaccinations

The labor judge of Naples, confirming the first-degree decision, has issued a verdict in favor of the medical manager employed by ASL Napoli 1, A.A., regarding the recognition of fair compensation for the work carried out during the Covid-19 vaccinations. The case saw the doctor act for the recognition of an adequate sum, equal to 80 euros per hour, for the work performed during the Covid-19 vaccinations. ASL Napoli 1 had previously paid him with the increases for daytime overtime work, a sum significantly lower than what was requested. The decision of the labor judge of Naples is based on the arguments of the defender, the lawyer Domenico Carozza, who argued that the parameter of additional performances used by the legislator was justified by the text of the collective contractual norm. On the contrary, the increase for overtime work was not relevant, as it was not linked to the specific Covid-19 emergency, according to the law. ASL Napoli 1 decided to appeal against the first-degree sentence, but the court confirmed the initial decision, stating that the requested compensation was justified and due based on the contractual regulation and the specific health emergency situation. This ruling represents an important precedent for all workers involved in the management of the Covid-19 emergency, confirming the need to ensure fair compensation for performances carried out during extraordinary and emergency situations.
