Domenico Belforte, leader of the namesake clan active in the Caserta area, spanning the towns of Marcianise, Capodrise, and the capital city, will remain under maximum security prison conditions because the Belforte clan is "still operational" despite continuous arrests and defections, and Belforte's purported cooperation is considered by the DDA (District Anti-Mafia Directorate) to be "instrumental", even though the clan leader has expressed the intention to recover the body of a victim to give them a proper burial.
The decision was made by the Surveillance Court of Rome, which rejected the handwritten complaint by Belforte himself after last September the Minister of Justice had extended the harsh prison regime provided by article 41-bis of the penitentiary system for another two years.
According to the judges of the capital, "Belforte continues to play a leading role and has not shown signs of repentance and definitive departure from the criminal logic of his clan of origin", and "Belforte's effort to convey orders and instructions for criminal actions to free associates or even those imprisoned is relentless." For these reasons, the judges have decided that Belforte must also remain under the 41-bis regime due to his conduct in prison, having received several disciplinary measures for various damages, three in particular since last October, when he was transferred from the prison of Cuneo to Sassari.
