Tragic Carbon Monoxide Poisoning at Milan Residence: Legal Proceedings Underway

The basement room where the boiler had been installed had not been minimally adapted to the technical and safety requirements and did not guarantee adequate ventilation; the system had not been tested; moreover, it had not only been left on, waiting to resolve the anomalies and the malfunctioning of the system, which continuously blocked and recorded repeated micro-explosions, but its power, hours of operation, and functions had also been increased; its maintenance, as well as the installation, instead of being entrusted to an authorized service center, had been assigned to a person completely lacking the necessary competence and preparation, co-responsible for the omissions and violations, who even fatally tampered with it by disconnecting a pipe. As a decisive consequence, the flue gas duct came off and carbon monoxide saturated the entire environment, also invading the rooms. All this, made even more serious, in a hospitality facility that accommodates dozens and dozens of guests. The charges brought by the Public Prosecutor of the Milan Prosecutor's Office, Dr. Isabella Samek Ludovici, holder of the criminal proceedings for the tragic death and the very serious injury caused by acute carbon monoxide poisoning respectively of Francesco Mazzacane, only 24 years old, from Torre del Greco, and his friend Pietro Caputo, today 21 years old, from Torre Annunziata, occurred on November 9, 2022, while the two young men from Naples were staying at the Residence Linate in Novegro di Segrate. At the end of the preliminary investigations, the Deputy Prosecutor has thus requested the indictment for the two subjects registered in the list of suspects: Claudio Giuseppe Gasperin, seventy years old, from Segrate, as the legal representative of the company Residenza Segrate Centro srl, owner of the hospitality facility where the tragedy occurred, in Via Carducci 7, as well as manager of the same, and Ion Grubi, 42 years old, of Moldovan origin but residing in Pioltello, the plumber to whom the installation and maintenance of the "illegal" boiler that determined the dramatic event had been entrusted. They will have to answer for the crime of manslaughter in competition, with the aggravating circumstance of having caused serious personal injury to another person: Caputo survived but after miraculously coming out of a post-anoxic coma with complete loss of consciousness, for a prognosis well over forty days and consequences that he will carry with him for the rest of his life. Acknowledging the request, the Gup of the Milan Court, Dr. Sonia Mancini has thus set for September 26, 2024, at 11:10 am, at the Palace of Justice in Via Freguglia, the preliminary hearing of a trial from which the families of Mazzacane and Caputo, who are all assisted by Studio3A-Valore S.p.A., expect truth and above all sentences commensurate with the serious and culpable conduct contested.
